PARTIES:
This Enrollment Agreement ("Agreement") is entered into between Federation of International Trade Investor Gunodaya Association (CIN: U85300UP2021NPL148971), a Section 8 company registered under the Companies Act 1956, having its registered office at 1905, 19th Floor, CV2, Supertech Capetown, Sector 74, Noida, Uttar Pradesh – 201306, India (hereinafter "FITIG"), and the applicant named herein ("Student").
1. TRUTH AND AUTHENTICITY
The Student declares that all information provided in this application is true, accurate, complete and authentic. Any false or misleading information shall result in immediate cancellation of enrollment without refund and may attract legal action under applicable Indian law.
2. INDEMNIFICATION
The Student fully indemnifies FITIG Association, its officers, faculty, staff, partner organisations and representatives from all claims, losses, liabilities, costs and legal expenses arising from: (a) the course enrollment and participation; (b) any injury, accident or loss during on-site practical sessions; (c) any use or misuse of course materials, tools or equipment; (d) any business or professional decision made using knowledge gained from this course; (e) any third-party dispute involving the Student in connection with activities related to this course.
3. COURSE CONDUCT & RULES
The Student agrees to: (a) attend all scheduled sessions to the best of their ability; (b) maintain professional conduct and respect for faculty, staff and fellow students at all times; (c) not record, reproduce or redistribute any course materials, lectures or proprietary content without prior written consent of FITIG; (d) abide by all facility rules during on-site practical sessions; (e) submit all assignments and assessments honestly without plagiarism.
4. NON-DISCLOSURE OF COURSE MATERIALS
All course materials, training content, methodologies, templates, client data used in case studies and proprietary frameworks are the confidential intellectual property of FITIG Association and its partners. The Student agrees not to: (a) share, reproduce, sell or publicly distribute any course materials; (b) use any proprietary materials for commercial purposes without written consent; (c) disclose confidential patient data, client information or case study details encountered during practical sessions. This obligation survives for 24 months after course completion.
5. NON-SOLICITATION
The Student will not directly solicit or approach any fellow student, faculty member, partner organisation employee or FITIG contact introduced through this course for independent commercial engagement that bypasses FITIG's role for a period of 12 months from course completion, without prior written consent of FITIG.
6. FEE & REFUND POLICY
Enrollment fees are non-refundable once the batch commences. Fees paid before batch commencement are refundable within 7 days of payment, less a processing charge of Rs 500. Security deposits are refundable upon satisfactory return of all equipment and course completion. If FITIG cancels a batch, enrolled students receive a full refund or transfer to the next batch.
7. CERTIFICATION & INTELLECTUAL PROPERTY
Upon successful completion, the Student shall receive a FITIG-certified certificate. This certificate may be revoked in cases of misrepresentation, fraud, gross misconduct, or breach of any provision of this Agreement. All intellectual property created during the course belongs to FITIG unless otherwise agreed in writing.
8. DATA PROTECTION & PRIVACY
FITIG collects and processes the Student's personal data for enrollment, course delivery, certification and legitimate communications in accordance with India's Digital Personal Data Protection Act 2023 (DPDP Act) and GDPR where applicable. Contact: privacy@fitigassociation.com
9. HEALTH, SAFETY & FORCE MAJEURE
FITIG shall not be liable for delays or cancellations caused by events beyond its reasonable control including natural disasters, pandemics, government orders, civil unrest or technology failures. In such events FITIG will endeavour to provide alternate arrangements including online delivery where feasible.
10. PLACEMENT & EMPLOYMENT
Where placement assistance is offered, FITIG acts only as a facilitator and does not guarantee employment. Placement outcomes depend on individual performance, market conditions and employer decisions. FITIG shall not be liable for any failure to secure employment following course completion.
11. LEGAL COSTS
FITIG being a non-profit association will not bear any legal expenses on the Student's behalf. Any dispute involving the Student's participation shall be the Student's sole financial responsibility. The Student shall protect FITIG from any financial liability arising from legal proceedings connected to the Student's enrollment.
12. JURISDICTION & GOVERNING LAW
This Agreement is governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts at Gautam Budh Nagar (Noida), Uttar Pradesh, India. Disputes shall first be referred to arbitration under the Arbitration & Conciliation Act 1996 before approaching courts.
13. ELECTRONIC SIGNATURE
The Student agrees that typing their full legal name in the signature field below constitutes a legally binding electronic signature under the Information Technology Act, 2000 (India) and is equivalent to a handwritten signature for all purposes of this Agreement.
